Effective date: 1 August 2026. These Terms govern use of https://donaify.com and the Donaify fundraising
platform.
1. Agreement and operator
These Terms of Service (the "Terms") form a binding agreement between you and Omni Spectrum
Technologies (SMC-Private) Limited ("Donaify", "we", "us", or "our"). By visiting the website, creating an
account, publishing or managing a campaign, making a donation, requesting a payout, or otherwise using the
services, you accept these Terms and the policies incorporated by reference.
If you do not agree, do not use the platform. Where mandatory consumer or data-protection law gives you
rights that cannot be waived, those rights continue to apply.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a contract.
A person under 18 may be a beneficiary, but a parent or legal guardian must create and manage the
campaign.
You must not be subject to sanctions, located in a prohibited jurisdiction, or legally barred from using the
services.
Organizations must act through an authorized representative who has authority to bind the organization.
3. Platform role
Donaify provides technology for creating, displaying, reviewing, and supporting fundraising campaigns.
Donaify does not endorse, guarantee, investigate every statement in, or assume responsibility for any
campaign. A campaign page is information supplied by its organizer and is not professional, legal, medical,
financial, tax, or investment advice.
Donaify is not the beneficiary of a campaign unless the campaign expressly identifies the Company as
beneficiary. Donaify is not a charity, bank, deposit-taking institution, investment platform, money-transfer
service, or regulated escrow service. Except where applicable law provides otherwise, use of the platform
does not create a trustee, fiduciary, partnership, joint venture, agency, employment, or deposit relationship.
4. Accounts and security
Provide accurate, current, and complete information and promptly update it.
Keep login credentials and verification methods secure and do not share accounts.
Notify us immediately of suspected unauthorized access or fraudulent activity.
We may require multi-factor authentication, additional verification, or account recovery checks.
You are responsible for activity performed through your account unless caused by our failure to use
reasonable security.
5. Campaign creation and organizer responsibilities
An organizer must describe the beneficiary, purpose, target amount, intended use of funds, relevant deadlines,
material risks, and relationship to the beneficiary truthfully and clearly. Organizers must obtain permission
before fundraising for another person and must be able to provide evidence of that permission.
Use funds only for the stated lawful purpose, subject to reasonable changes that are transparently
disclosed.
Maintain receipts, invoices, medical records, quotations, beneficiary consents, or other evidence
reasonably requested by Donaify.
Post material updates and promptly disclose changes that may affect donor decisions.
Comply with all laws, tax rules, sanctions, card-network rules, and payment-provider requirements that
apply to the campaign.
Do not make false, exaggerated, unverifiable, misleading, or guaranteed claims.
6. Campaign review and publication
Submission does not guarantee publication. We may approve, reject, limit, pause, request edits or documents,
or remove a campaign at any time. Review is risk-based and is not a certification that a campaign is genuine,
safe, lawful, tax-deductible, or suitable for any donor.
7. Identity verification, AML, and sanctions
Organizers, beneficiaries, authorized representatives, donors, and payout recipients may be required to
complete identity, address, organization, bank-account, source-of-funds, source-of-wealth, liveness, sanctions,
politically exposed person, adverse-media, or enhanced due-diligence checks. We may use specialist service
providers and may request further information at any time.
We may restrict, delay, reject, freeze, reverse, or report activity when required by law, a court or authority, a
payment provider, a card network, a bank, or our risk controls. We may decline to explain a restriction where
disclosure would be unlawful or would compromise fraud or compliance controls.
8. Donations and payment authorization
Donations are voluntary and do not purchase goods, services, equity, debt, ownership, profit, repayment, or a
guaranteed outcome. Before authorizing payment, donors must review the campaign, amount, platform fee
treatment, processing fee, total charge, currency, and refund rules.
Payments are accepted in USD through payment methods made available by approved third-party processors.
Visa, Mastercard, Apple Pay, and Google Pay may be available depending on the processor, card issuer,
device, browser, and country. A donation is not complete until the processor confirms successful authorization
and settlement.
9. Fees and currency
Platform fee: 3% of the gross donation, normally deducted before the campaign balance is paid out.
Payment-processing fee: charged to the donor and disclosed before payment confirmation.
Currency: campaign amounts and Donaify balances are denominated in USD.
A donor's bank or wallet provider may convert currency and charge separate fees or apply its own
exchange rate.
Payout, intermediary-bank, return, chargeback, or compliance costs may be deducted where disclosed or
permitted by law.
10. Flexible funding and campaign goals
Unless a campaign page expressly states that it uses an all-or-nothing model, campaigns use flexible funding.
Funds may become eligible for payout even if the stated target is not reached. Failure to reach a target is not
by itself grounds for a refund.
11. Receipt, ledgering, holds, and campaign balances
To the extent permitted by law and payment-provider arrangements, donations may be received into an
account controlled by the Company before payout. We maintain internal ledger records attributing eligible net
amounts to campaigns. A displayed campaign balance is a conditional accounting record, not a bank deposit,
stored-value product, interest-bearing account, or unconditional debt immediately payable to the organizer.
Amounts may remain unavailable because of authorization, settlement delays, verification, reserves, refunds,
suspected fraud, chargebacks, disputes, sanctions screening, technical errors, negative balances, or legal
requirements. Organizers have no unconditional right to payout until all applicable conditions are satisfied.
12. Payouts
Payouts are manual and must be requested by an eligible organizer.
The minimum eligible payout is USD 25.
The organizer and payout recipient must complete required verification, and the destination account must
normally be in the verified person's or organization's name.
We aim to begin reviewing a complete request within five business days, but review and transfer times are
estimates and may take longer.
We may pay in installments, maintain a reserve, set off refunds or chargebacks, or require updated
evidence before releasing funds.
Availability depends on supported countries, banks, payout partners, and applicable law.
13. Supported campaign countries
Campaign creation may be made available to verified organizers in Pakistan, the United States, the United
Kingdom, Canada, Australia, New Zealand, Singapore, Malaysia, the United Arab Emirates, Saudi Arabia,
Qatar, Kuwait, Bahrain, Oman, and selected European Union or European Economic Area countries. This is
not a promise of availability. We may add, remove, or restrict countries based on KYC, payout capability,
sanctions, provider coverage, and legal requirements.
14. Refunds, reversals, and chargebacks
Donations are generally final. Refunds may be considered for unauthorized or fraudulent card use, duplicate
donations, technical or processing errors, campaign removal for confirmed fraud or policy breach, or when
required by law or a payment provider. A donor changing their mind, a campaign failing to reach its goal, or
dissatisfaction with lawful use consistent with the campaign are generally not refund grounds.
A completed payout may limit our ability to provide a voluntary refund, but it does not limit rights required by
law or card-network rules. We may deduct refunds, chargebacks, retrieval fees, penalties, or losses from
campaign balances, reserves, future donations, or amounts otherwise payable to an organizer.
15. Taxes and receipts
Users are responsible for determining and paying taxes, duties, reporting obligations, and registration
requirements that apply to donations, fees, income, gifts, or payouts. Donaify does not guarantee that a
donation is tax deductible. Any receipt is a transaction record and not a tax certificate unless expressly issued
by a qualified organization under applicable law.
16. Prohibited and restricted use
You must comply with the Prohibited Activities Policy and Acceptable Use Policy. Prohibited conduct includes
illegality, fraud, false fundraising, money laundering, terrorism, sanctions evasion, weapons, illegal drugs, adult
services, gambling, investment schemes, hate or violence, intellectual-property infringement, and any activity
disallowed by a bank, processor, card network, or applicable law.
17. Content and intellectual property
You retain ownership of content you submit. You grant Donaify a worldwide, non-exclusive, royalty-free,
sublicensable license to host, store, reproduce, adapt for formatting and accessibility, display, distribute,
promote, moderate, and use that content as needed to operate and market the campaign and platform.
You represent that you have all rights and consents needed for the content, including images, names, medical
details, documents, and information about beneficiaries. Do not publish another person's sensitive information
without lawful authority and appropriate consent.
18. Moderation, suspension, and termination
We may investigate, restrict visibility, disable donations, place holds, suspend accounts, remove content,
reject payout requests, close accounts, or preserve and disclose records where we reasonably believe it is
necessary for safety, compliance, legal process, provider rules, or platform integrity. Where appropriate, we
may give an opportunity to respond, but urgent action may occur without prior notice.
19. Third-party services
Payment processing, digital wallets, identity verification, fraud screening, hosting, analytics, communications,
banking, and payouts may be provided by third parties under their own terms and privacy notices. We are not
responsible for outages, declines, holds, exchange rates, fees, or acts of third parties outside our reasonable
control.
20. Disclaimers
The platform is provided on an "as available" and "as is" basis to the maximum extent permitted by law. We do
not warrant uninterrupted access, campaign accuracy, fundraising success, donor behavior, payout timing,
beneficiary conduct, tax treatment, or that any particular payment method or country will remain available.
21. Limitation of liability
To the maximum extent permitted by applicable law, Donaify and its officers, employees, contractors, and
affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential loss; loss of
profit, opportunity, goodwill, or data; campaign failure; organizer misconduct; donor decisions; payment-
provider action; or events outside reasonable control.
Where liability cannot lawfully be excluded, our aggregate liability arising from a specific transaction will not
exceed the fees actually retained by Donaify from that transaction during the six months before the event
giving rise to the claim, except for liability that applicable law does not allow us to limit.
22. Indemnity
To the extent permitted by law, an organizer agrees to indemnify and hold harmless Donaify from claims,
losses, chargebacks, penalties, taxes, expenses, and reasonable legal costs arising from the organizer's
campaign, content, breach of these Terms, misuse of funds, violation of law, or infringement of another
person's rights.
23. Governing law and disputes
These Terms are governed by the laws of Pakistan, without prejudice to mandatory rights that apply in a user's
country. Before filing a claim, contact us and allow at least 30 days to attempt an informal resolution. Subject
to mandatory law, the courts of competent jurisdiction in Multan, Punjab, Pakistan will have jurisdiction.
24. Changes
We may update these Terms to reflect changes in law, providers, platform features, risk controls, or business
practices. Material changes will be posted with a revised effective date and, where appropriate, additional
notice. Continued use after the effective date means acceptance of the updated Terms.
